Terms & Conditions
These terms ("Terms") govern your use of cozybycoffield.com (the "Site"), operated by Cozy by Coffield, LLC ("Cozy by Coffield," "we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site. Our Privacy Policy, available on the Site, is incorporated into these Terms by reference and explains how we handle your information.
Eligibility
You must be at least 18 years old, or have the legal capacity to enter into a binding contract in your jurisdiction, to use the Site or engage our services.
Website Information and Services
Site content is general information and an invitation to discuss services; it is not a binding design proposal or contract. Booking a call, submitting a form, or downloading a guide does not create a client relationship. Services begin only after both parties sign a separate written service agreement, which will govern the project and controls over these Terms if the two conflict.
Pricing and Project Scope
Displayed package prices describe the listed scope and may change without notice. Full-Service Styling is quoted within the displayed range based on room size, scope, sourcing, installation, and other project needs. Furnishings, décor, contractor work, delivery, travel, taxes, and other project expenses are separate unless a written proposal states otherwise.
Deposits, Cancellations, and Refunds
Projects typically require a deposit before work begins, as specified in your signed agreement. Deposits are generally non-refundable once sourcing, design work, or scheduling has commenced, except as required by law or as your agreement provides. Cancellation terms, rescheduling policies, and any refund eligibility will be set out in your signed agreement.
Design Decisions and Third Parties
Concepts, renderings, product suggestions, and measurements should be reviewed and approved by you before purchase or installation. Product pricing and availability may change and are outside our control. Licensed or qualified professionals should perform any work that legally requires them. We are not responsible for the acts, omissions, or work quality of independent contractors, vendors, manufacturers, shipping carriers, or third-party websites, except as required by law.
Content You Submit
When you submit photos, measurements, messages, or other materials through the Site or during a project, you grant us a non-exclusive, royalty-free license to use that content to provide the requested services. Any use of your project photos in our marketing or portfolio requires your separate, specific consent, as described in our Privacy Policy — submitting content to us for a project does not by itself authorize marketing use.
Intellectual Property and Acceptable Use
The Site, our branding, copy, guides, designs, and original images are owned by or licensed to Cozy by Coffield and may not be copied, sold, republished, or used commercially without our written permission. You may use a downloaded guide for your own personal, noncommercial use. Do not misuse the Site, attempt to interfere with its operation or security, or submit unlawful, infringing, or harmful material.
No Guarantees; Disclaimers
Design results depend on your space, budget, decisions, product availability, and other factors outside our control. Testimonials and portfolio examples are illustrative and do not guarantee identical or similar results. To the fullest extent permitted by law, the Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied. Nothing in these Terms limits any right or liability that cannot legally be limited, including liability for fraud, gross negligence, or willful misconduct.
Limitation of Liability
To the fullest extent permitted by law, Cozy by Coffield will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our services. Our total liability for any claim arising from the Site or a project will not exceed the total fees you paid to us for the specific project giving rise to the claim.
Indemnification
You agree to indemnify and hold Cozy by Coffield harmless from claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Site, or the acts of contractors or vendors you engage directly, except to the extent caused by our own negligence or breach of our agreement with you.
Suspension and Termination
We may suspend or restrict your access to the Site if we reasonably believe you have violated these Terms or misused the Site. This does not affect any separate written service agreement already in place, which is governed by its own terms.
Electronic Communications
By using the Site or engaging our services, you consent to receive communications from us electronically, including via email and electronic signature, and agree that electronic signatures and records satisfy any legal requirement that such communications be in writing.
Accessibility
We want the Site to be usable by everyone. If you experience difficulty accessing any part of the Site, please contact us and we will work to address it.
Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in New Castle County, Delaware, unless applicable law requires otherwise.
General
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force. These Terms, together with any signed service agreement and our Privacy Policy, constitute the entire agreement between us regarding the Site. We may update these Terms at any time by posting a revised effective date; continued use of the Site after changes means you accept the updated Terms.
